Question by : appeal for unemployment?
I have been in the determination of eligibility stage for over a month and a half. Today it was decided that i was ineligible indefinitely. I have decided to appeal via phone conference. I live in Minnesota, I lost my job because i was a pizza delivery driver and i got a DWI while not on the job and had my license revoked for 1 year. I didn’t just deliver pizzas for my job. I also did things around the shop like prepare food, clean, serve customers..etc

The reason i am appealing is because my license wasn’t needed for all of my duties at work. I delivered pizzas also there was other important duties i did including cooking, cleaning, preparing ingredients, serving customers and taking orders. I had many other duties at my job that did not require having a license. Necessarily my license was not needed for these duties. When i lost my license i asked my boss if i could continue working and he asked how i would get to and from work and i stated i had transportation from my father or bus route. I told my boss that i could continue my duties cooking, cleaning…etc my boss said that i wasn’t needed for those duties anymore and told me to call him when i get my license back. I could have continued to do my other duties around the store without my license.

This is the reason they stated me ineligible.
Determination of Ineligibility
Reasonings and Findings
Under Minnesota Statute section 268.095, an applicant is not eligible for unemployment benefits if
the applicant is discharged for employment misconduct. The law defines employment misconduct
as intentional or negligent conduct that is a serious violation of standards of behavior the
employer has the right to reasonably expect. Failing to obtain or maintain a driver’s license or
certification is employment misconduct if the license or certification was a relevant condition of
hire or continuing employment, and if the failure to obtain or maintain the license was due to the
applicant’s neglect or intentional conduct. The employer discharged the applicant during the week
beginning 09/11/2011 for failing to obtain or maintain a driver’s license or certification. The license
or certification was a relevant condition of hire or continuing employment. The failure was due
to intentional or negligent conduct by the applicant. The applicant’s actions were employment
misconduct.

Do i have a good defense? I didnt need my license for all of my job duties. I have the appeal date set on the 1st of november.
I was hired as a pizza delivery driver but as the work progressed i gained more duties. I could have done those duties without a license.

In your first paragraph you state that you were a pizza delivery driver. If you lost you license, you can no longer perform ALL of the duties of your job. I don’t think your appeal will be successful. Sorry.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

I’m looking for a good and free site that could give me full and thorough legal advice and answer my specific individual questions.
Anyone got any place in mind?
And please, don't just say 'google it'.
I've done plenty of research already. This place is usually my last resort.
But I also want to know what free legal advice sites people are relying on themselves.

Depends about what subject? I know alot of website that give you free legal advice that deals with family law. They have forums on the websites, where lawyers write back their answers. It’s not always easy to find a site that can give you free legal advice though. Only an attorney/lawyer can give out legal advice (other than a judege etc.) Paralegals can’t give legal advice at all. Google what type of law you want advice for and see what sites come up and look for a forum or FAQ (frequently asked questions)
