The charge doesn’t go away, but technically you are not convicted. However, it has become an issue in many states that to obtain deferred sentencing you must enter a guilty plea. This is what government agencies and other sensitive employers hold against you. You need to speak with an attorney in your state to see if an exponent is possible, now, or at some time in the future. Good luck.

PHOENIX OFFICER ACCUSED OF DUI WITH KID IN THE CAR

Posted: 25 May 2012 11:05 AM PDT

PHOENIX – A Phoenix Police Officer is on the wrong side of the law for getting busted while driving under the influence. And to make matters worse, he had a child in the car when he was arrested. Deputies say Phoenix Police Officer Brian Gentry was driving drunk with a kid in his car. He has been arrested, accused of driving under the influence, a felony. MSCO deputies say it happened right after the PIR race on March 4. A Goodyear police officer pulled Gentry over. That officer says a 7-year-old was in the car. MCSO’s DUI task force took over and gave Gentry a breath test and a blood test. Deputies say initial tests show he was over the legal limit. Gentry was arrested and released to another person to drive him home. Last year, another Phoenix Police officer was accused of driving under the influence with a child in the car. Sgt. John Flanagan was fired in August. Phoenix police say Gentry is a decorated officer. He recently was awarded two medals — one for saving a woman’s life in a suicide attempt, the other for saving a man’s life. Gentry was taken off patrol duty while the investigation continues – 13 March 2012.
