www.ithacadwi.com The New York Refusal case is a unique situation. You will only be charged with a common law DWI. This is under VTL 1192 (3). One of the problems with a refusal case is the license issue. In most cases you will lose your administrative license hearing. The judge will find you to be a “true” refusal legally, and then revoke (cancel) your license privileges to drive for one year. When do you get these privileges back? How can you get them back?
