This is just because I’m curious if others have dealt with this. A co-worker of mine was arrested last week at a sobriety checkpoint for DUI. They smelled beer on him, they pulled him out and put him through the show. But here’s the thing… he had two beers only. I know, because I was there with him when he consumed them before he left the bar. It was a Friday, post work, happy hour thing, he could not have been there more than 30 minutes. When I asked him about the field check (walking the straight line, touching your nose, etc.) he says there was no problem. The problem came when he blew a .03 on the breathalyzer. My first response was, well why were you arrested? You were well under the legal limit, why were you arrested? That’s what he said too. He still looked stunned. He was arrested for operating a vehicle under the influence. Not INTOXICATED, but under the influence of alcohol.

Does this sound right to you? Can they really do that?

Absolutely, provided there is evidence of impairment. Performance on the field sobriety tests, observations of fine motor skills, balance, etc… can all be used to build a DUI/DWI case.

Personally, if I stopped someone who bombed the Field Sobriety Tests, and they only blew a .03, I’d be heading to the hospital with that person to have blood drawn to check for other substances. Odds are, usually the test reveals drugs in the system of the offender.

Hopefully someone can give me knowledgeable advice. The situation is I have five little cases open. The most major one is a DUI (from 2008) that just turned into a warrant, driving with a suspended license, jay walking, talking on a cell while driving and drinking in public. Ive been talking to people and I’m about to turn myself in and just handle it while I’m 23 because I wanna join the service. Anyone know; how much time I will do approx? Or any advice on how I can deal with this situation the best way? I’m just trying to get all this off my back so I can continue living a clean ligitimit life.

As a former prosecutor, I respected individuals who turned themselves in rather than being caught – when it came to warrants. I don’t know if these in fractions all occurred in the same jurisdiction (like the same city, county, court district) and/or you’d be dealing with the same district attorney on all matters – but you could reach out to the attorney and inquire what you should do to resolve all of these matters.

Now, he/she may not want to talk to you – then you should seek out an attorney for some assistance. A good defense attorney should be willing to sit down with you and discuss your rights and what could happen to you on these files – without you having to hire him or her and/or it costing you anything.

That being said, an experienced defense attorney can be a real asset b/c they work in these areas on a day to day basis. When you speak to one, carefully explain what you want to see happen – and ask whether they can get it for you. If they can’t – ask why. Then, go to the next one – ask it again … armed with what the 1st attorney told … this should help you to understand what it is you should really expect. Then you can determine whether it is worth hiring attorney to do this work for you.

My friend was stopped for DUI – the cop was out of breathalyzer tubes and had my friend do the “pen test” which he ‘failed’. The cop then made an arrest based solely on the pen test. Was this arrest legal and does it help his case any to have been arrested without a breathalyzer test? He was digging his car out of a snowbank at the time, was NOT driving. (South Dakota)

I think your friend should get a good lawyer who can get this thing either reduced or thrown out of court all together.

My sister got arrested last night for disorderly conduct b/c her boyfriend lunged at her while she was holding her son and she bit his wrist in defense. She was arrested but was never read her miranda rights. Does anyone have any legal advice for her? What can she do regarding these charges?
She has no other records except one fine for a seatbelt violation.

She should wait to see if the charges are indeed filed. Then she should seek legal counsel. She will be entitled to a public defender if she cannot afford an attorney.
