Question by freddy_jbu: What does adjudication of guilt withheld mean in Florida?
This is for a moving violation ticket.. I had an Affidavit for my court date and the “adjudication of guilt was withheld” and I have to pay the fine amount. If I am not misunderstood, I was found not guilty of the crime, still have to pay the fine, and no points will be put on my license. Correct?

I am curious about points on license & payments. Not all the technical details… Thank you.

You need to contact the Clerk of the Court to be sure.

Withheld adjudication generally refers to a decision by a judge to put a person on probation without an adjudication of guilt. It means a person is not found guilty legally by the court. If the person successfully completes the terms of probation and has no subsequent offenses, no further action with be taken on the case and the offense for which adjudication was withheld is typically not considered a prior conviction for purposes of habitual offender sentencing. If the person does not complete the terms of probation, a finding of guilty may be entered and the person may be sentenced according to the punishments defined for the offense.

Find out what your terms were stated by the court. If you were ordered to attend traffic school…the you must do that within the time allocated by the court and prove to the court you did as instructed. A failure to do as you were told will result in a reversal of the “nolo contendere” and you will be found guilty.
