Question by Gregory M: Can a court find you guilty of Driving While Suspened if the ticket was mailed to you?
I was accused of Driving while Suspended from the township in new jersey that suspended my license back in april, I was not pulled over. I recieved a letter in the mail stating I was observed driving a vehicle I’ve been known to drive while I had my license. Any advice as to a defense? I have court trial on Tuesday and I am facing 10-90 days if found guilty because my license was suspended for a DWI. I understand Credibilty, but they never gave pursuit nor was I even driving. The car is not registered or insured under my name. The offficer claims to have seen the vehicle in a neighboring township across from my girl friends house, but again I was not in the vehicle. I recieved this letter a few days after the ticket was written up. Help?

How the citation is delivered is not significant. It is possible the officer was busy with another call and could not stop the vehicle.

It is up to them to prove you were driving, you do not have to prove you were not. The rest is up to the court.
